Columbia University Joins Amicus Brief Filed Against Trump 'Travel Ban' Penn steps up efforts to oppose Trump immigration ban

The schools said in papers filed at a federal court in NY on Monday that the order blocking travel from seven predominantly Muslim countries threatens their abilities to educate future leaders from almost every continent.

According to the brief, because research universities, as part of their global mission, "seek to educate future leaders from almost every continent, attract the world's best scholars, faculty and students, and work across worldwide borders, they rely on the ability to welcome worldwide students, faculty and scholars into their communities".

In some cases the impact was immediate, they argued, causing significant hardship for scholars: Six students and scholars at Princeton University were outside the country and unable to return when the ban was put in place, for example, and an additional 45 were unable to leave the United States.

The lawsuit originated from an American Civil Liberties Union challenge of the executive order and was joined by New York State Attorney General Eric Schneiderman about two weeks ago.

The schools include Brown, Columbia, Duke, Harvard, Yale, Vanderbilt, Princeton and Stanford.

The brief comes after a January 27 order that blocked entry to the people from seven predominately Muslim countries: Iran, Iraq, Libya, Somalia, Sudan, Syria, and Yemen.

Stanford leaders have joined others in the academic community in criticizing the executive order and have articulated key principles for Stanford's response. The 9th U.S. Circuit Court of Appeals in San Francisco subsequently upheld the court order.

Ten percent of Duke's undergraduates, and 47 percent of graduate students, are global, according to the brief.

"Moreover, if a valid visa may be revoked at any moment based simply on a person's country of origin, the Executive Order alters the perceived cost-benefit analysis of studying or teaching here, even for persons from countries unaffected by this particular Executive Order", the brief says.

While some schools, such as Brown, Penn and Cornell, had single-digit percentages of their faculty from overseas, almost one-third of Princeton's faculty, and fully half of its academic professionals, visiting faculty and researchers this fall were worldwide.

Trump's executive order prompted large protests at airports and a flurry of lawsuits.

"The decision shuts down the executive order immediately", Ferguson said during a news conference after Robart's ruling.

Yet the president continues to say he's open to legally challenging the blocks that courts have instituted on his travel order, insisting it's crucial for national security.

"We believe the amicus brief will be of value to the court", said Stephen J. MacCarthy, Penn's vice president for university communications.
